Terms of Use

These Terms of Use ("Terms") are an agreement between you and [to be added before launch], which operates RealEstateKart ("the platform"). By creating an account or using the platform you agree to these Terms, the Privacy Notice and the Community Guidelines.

1. Who can use it

You must be 18 or older and in India. The platform is offered for properties located in India. One person, one account; you are responsible for activity on your account.

2. What we are

RealEstateKart is an intermediary under the Information Technology Act, 2000: we host listings and messages posted by users. We are not a broker, agent or party to any sale, lease or payment between users, and we do not verify ownership, title, approvals or the accuracy of listings. Do your own checks before paying anyone. Never pay a token, deposit or advance before visiting the property and checking documents. Posting and browsing are free.

3. Your listings and content

• You must have the right to list the property (owner, or authorised agent / builder), and must choose the correct badge. Brokers must not present themselves as owners.
• Listings must be truthful: real photos of that property, a correct price and availability. Mark listings sold / rented promptly.
• Builders and agents must comply with the Real Estate (Regulation and Development) Act, 2016: projects that must be registered with the state RERA can only be advertised with their RERA registration number.
• You grant us a non-exclusive, royalty-free licence to host, resize, display and distribute your content on the platform, for as long as it is on the platform.
• Phone numbers, emails and links typed into listing text are hidden automatically; use the app's contact settings instead.

4. Prohibited content (IT Rules, 2021, Rule 3(1)(b))

You must not post, share or send anything that:

• belongs to someone else and you have no right to;
• is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), or insulting or harassing on the basis of gender;
• is defamatory, racially or ethnically objectionable, or promotes enmity between groups on grounds of religion, caste, community or language, including listings that exclude people on these grounds;
• is harmful to children;
• deceives or misleads about its origin, or knowingly spreads false or misleading information, including fake or scam listings;
• impersonates another person, including posing as the owner of a property you don't own;
• threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or incites any offence;
• contains malware or is designed to interfere with any computer resource;
• violates any law in force in India, or infringes any patent, trademark, copyright or other proprietary right.

5. What we may do

We may hide or remove content, limit features, or suspend or terminate accounts that break these Terms, the Guidelines or the law, and we act on orders from courts or authorised government agencies within the time the IT Rules require. Automated checks may mask contact details and flag content for human review. Where appropriate, we tell you why content was removed. You can dispute it through the grievance process.

6. Advertising

The platform is free and supported by ads from Google AdMob. Ads are non-personalised unless you opt in. Ads are not endorsements; deal with advertisers at your own risk.

7. Disclaimers and liability

The platform is provided "as is". To the extent permitted by law, we are not liable for any loss arising from dealings between users, the content of listings, or fraud by other users. Nothing in these Terms limits liability that cannot be limited under Indian law.

8. Ending your account

You can delete your account at any time in the app. We may end accounts as described above.

9. Governing law and disputes

These Terms are governed by the laws of India. Courts at [to be added before launch] have jurisdiction, subject to your rights as a consumer. Please try the grievance process first.
